The Centers for Medicare & Medicaid Services (CMS) has released the 2027 Medicare Advantage & Part D Final Rule, and it marks a significant change in how Medicare agents are expected to operate.

CMS is removing rigid timing rules and replacing them with clarity, transparency, and consumer choices. For agents, this means more flexibility but also greater responsibility for how you communicate and document your client interactions.

Key Changes That Impact Your Day-to-Day

Simplified Call Recording Rules

One of the most agent-friendly upates:

  • Only calls that result in enrollment must be recorded
  • Marketing calls now have reduced retention to 6 years
    • Audio: 3
    • Transcripits: 3
  • Enrollment records still require a 10-year retention

No More 48-Hour SOA Waiting Period

This is a major shift!

  • Agents can now discuss plans immediately after completing a Scope of Appointment (SOA)
    • Same-day, same-call, or same-meeting conversations are allowed

Clearer TPMO Disclaimer Rules

If you operate as a TMPO (Third-Party Marketing Organization):

  • Disclaimers are still required
    • Only before discussing plan benefits (not at the very start)

Flexibility in Event Scheduling

You can now host education and sales/marketing events on the same day.

  • The prior 12-hour buffer is gone
  • You must clearly seperate educational from sales

What Has Not Changed

Some fundamentals remain the same:

  • SOAs are still required
  • Misleading or deceiptive marketing is still prohibited
  • TCPA rules still apply (no overcommunication)
  • Consumers must always have the option to decline, pause, or leave
